Registration of Ownership Rights in Southeast Aceh Regency: A Study on the Current Status and Recommendations for Improvement

Introduction

The registration of land ownership is a crucial step in providing legal certainty and disciplining land ownership in a region. In Southeast Aceh Regency, the registration of land ownership is still relatively low, with only 483,496 m² registered as property out of a total area of 4,231,410,000 m². This study aims to understand the condition of the community related to land registration, the factors causing low registration, and the steps that need to be taken by the government to increase land registration of ownership rights in this area.

The Importance of Land Registration

Land registration is essential for the National Land Agency (BPN) and other relevant agencies, as well as providing great benefits for the community. According to the Agrarian Act No. 5 of 1960 and further regulated in Article 3 PP No. 24 of 1997, the purpose of this registration is to guarantee legal certainty for all Indonesian people, as well as regulating the position of land based on simple customary law. In this context, land registration becomes essential for the National Land Agency (BPN) and other relevant agencies, as well as providing great benefits for the community.

Research Methodology

The study was conducted with a normative and juridical sociological approach, descriptive and prescriptive, in three districts in Southeast Aceh Regency: Babussalam, Bambel, and Lawe Sigala-Gala. Data was collected through a questionnaire that was distributed to 54 families from nine villages chosen by purposive sampling.

Research Result

The results showed that people who had and had not registered their land rights could be seen from two aspects. First, aspects of the subject of ownership which includes age, education, and land owner's work. Second, aspects of the object of ownership related to the location of the land. There are two main factors that cause low registration of land ownership.

Juridical Factor

First, legally, there are still no strict rules regarding sanctions for landowners who do not register their land. Lack of systematic and clear regulation regarding the registration process is also an obstacle. This shows that there is still a need for government policies that are more supportive to encourage the community to register land. In addition, education about the importance of land registration needs to be improved so that people understand the benefits of registration.

Sociological Factors

Second, sociological factors, where there are still many customary property rights that have not been registered, unproductive land, the location of land that is far from settlements, high registration fees, and the registration process is not systematic. These factors influence people's decisions to register their land rights. The existence of customary land that has not been registered also indicates the uncertainty of legal status that can harm the landowner.

Recommendations for Increasing Registration

In order for the registration of land ownership in Southeast Aceh Regency to increase, the Regional Government of Nanggroe Aceh Darussalam Province, together with the Regional Government of Southeast Aceh Regency, needs to make qanun or regional regulations regarding land registration. This regulation is expected to include all types of land rights and unproductive land use in accordance with the provisions of Law No. 44 of 1999 and Law No. 18 of 2001.

Cooperation between the government and the Faculty of Law and Research Institutions is also important to educate the public about the importance of land registration. In addition, the government can give awards to PPAT officers who carry out their duties well and provide incentives for people who have registered their land. Eliminating registration fees for poor people can also be a solution to increase community participation in the land registration process.

Conclusion

Registration of ownership rights in Southeast Aceh Regency requires serious attention from the government and the community. With the right steps and the existence of supporting regulations, it is hoped that registration of land ownership can increase, provide legal certainty and order in land control, and bring benefits to the wider community.

Future Research Directions

This study provides a foundation for future research on the registration of land ownership in Southeast Aceh Regency. Future studies can explore the impact of land registration on the community, the effectiveness of government policies in increasing land registration, and the role of customary law in land ownership.

Limitations of the Study

This study has several limitations. The sample size is relatively small, and the study only focuses on three districts in Southeast Aceh Regency. Future studies can increase the sample size and include more districts in the study.
